“Any whatover fact of man which causes damage to others obliges him through whose fault it has arrived to repair it.”

There are 2 main elements :

There is a fault if:

  • The damage exists in the head of the victim …
  • There is a causal link between the fact and the damage …

This is a very interesting article of law and widely used in Latin law where jusiprudence is less pronounced than in Anglo-Saxon law.
